ALLMÄNNA VILLKOR OCH
SÄKERHETSREGLER – HOT ROD RIDERZ

Dessa villkor gäller vid hyra av fordon ("Mini Hot Rod") från Scharrenberg & Magnusson AB (org.nr: 559550-8481), hädanefter kallat Uthyraren.

SÄKERHETSREGLER

Deltagande sker helt på egen risk. Vid överträdelse av säkerhetsreglerna äger Uthyraren
eller utsedd guide rätt att omedelbart avbryta turen. Avtalet anses därmed fullföljt från
Uthyrarens sida och ingen återbetalning lämnas. Eventuell hemtransport av fordon sker på deltagarens bekostnad.

• ID och körkort: Giltigt fysiskt B-körkort samt giltig identitetshandling ska uppvisas före avfärd.
• Nykterhet och droger: Strikt 0,0 promillegräns samt absolut förbud mot droger och läkemedel som påverkar körförmågan.
• Klädsel: Slutna, stadiga skor är obligatoriskt (inga flip-flops, pumps eller högklackat).
• Väderanpassade kläder krävs utan löst hängande detaljer (t.ex. fladdrande
  halsdukar).
• Körbeteende i grupp:
  • Inga omkörningar inom gruppen. Ändring av körordning får endast ske på
    instruktion från guiden.
  • Körning sida vid sida är förbjuden.
  • Aggressiv körning (drifting, hjulspinn, skrikande däck) samt att medvetet
    stanna kvar/släpa efter är förbjudet.
  • Gruppen får inte lämnas under pågående tur.
• Väder och väglag: Vid vått väglag ska hastigheten anpassas kraftigt. Turer ställs in
  vid ihållande regn. Körning på snö, is eller i terräng är helt förbjuden.
• Utrustning och medpassagerare:
  • Ingen extra packning får medföras i fordonet (stora väskor, ryggsäckar etc.).
  • Ingen mobilanvändning eller fotografering/filmning under körning.
  • Inga medpassagerare (inklusive barn eller husdjur) är tillåtna.
  • Broms och gas får inte användas samtidigt.
• Övrigt:
  • Fordonen hyrs endast ut inom ramen för guidade turer. Individuell uthyrning erbjuds ej.
  • Racing eller hastighetsinriktad körning är förbjuden.
  • Guidens anvisningar ska alltid följas.
• Varje fordon är utrustat med varningstriangel och första hjälpen-kit.

ALLMÄNNA VILLKOR FÖR UTHYRNING

1. Avtalets omfattning

Hyra av fordon sker i enlighet med erhållen bokningsbekräftelse samt dessa allmänna villkor och säkerhetsregler. Genomförd bokning samt erhållen bokningsbekräftelse utgör
tillsammans med dessa villkor det fullständiga, bindande hyresavtalet mellan hyrestagaren och Scharrenberg & Magnusson AB (Hot Rod Riderz). Muntliga överenskommelser är endast giltiga om de bekräftats skriftligen av Uthyraren. Uthyraren förbehåller sig rätten att neka uthyrning utan att ange skäl.

2. Bokning, betalning och avbokning

• Bokning och betalning: Bokningen blir bindande vid skriftlig bekräftelse från
  Uthyraren. Hyresavgiften ska betalas i samband med bokningen. Digitalt hyresavtal, i form av ett formulär från uthyraren, ska fyllas i och undertecknas innan turen börjar.
• Avbokning av kund:
  • Fri avbokning och ombokning kan ske fram till 24 timmar innan turens start.
  • Vid utebliven ankomst, sen ankomst (senare än 20 minuter före utsatt
    avgång) eller annan försening som gör att turen missas utgår ingen
    återbetalning.
  • Vid förhinder på grund av sjukdom på turens dag återbetalas beloppet i form av ett presentkort.
  • Om kunden väljer att avbryta eller förkorta en pågående tur lämnas
    återbetalning för den outnyttjade tiden i form av ett presentkort.
• Inställd tur från Uthyraren:
  • Vid inställd tur på grund av svåra väderförhållanden eller oförutsedda
    händelser utanför Uthyrarens kontroll (Force Majeure) erbjuds kunden
    ombokning till nytt datum, presentkort eller full återbetalning.
  • Om Uthyraren ställer in turen på grund av tekniska fel återbetalas hela
    beloppet till kunden.

3. Särskilda fordonsegenskaper och risker

Fordonet är ett specialfordon vars köregenskaper avviker från vanliga personbilar. Körning sker på egen risk. Uthyraren ansvarar inte för skador som uppstår till följd av fordonets särskilda konstruktion.

• Särskilda egenskaper: Låg profil (svårare att upptäcka i trafik), saknar bälten, saknar ABS och krockkuddar, har automatväxel med direktstyrning samt vänsterfotsbroms.
• Hyrestagaren är skyldig att göra sig förtrogen med fordonet före start, genom en
  testkörning anvisad av guiden.
• Skydd mot väder saknas.
• Skador orsakade av väderförhållanden ersätts inte av Uthyraren.

4. Krav på förare och användning av fordonet

Endast förare som namnges i hyresavtalet får framföra fordonet. Föraren måste vara minst 18 år och inneha ett giltigt fysiskt B-körkort.

• Nykterhet och körförmåga: Det är strikt förbjudet att köra under påverkan av
  alkohol, droger eller mediciner. Förarens körförmåga måste vara helt intakt.
  Scharrenberg & Magnusson AB (Hot Rod Riderz) samt utsedd guide har rätt att
  omedelbart avbryta körningen vid misstanke om olämplighet.
• Körregler: Fordonet får endast framföras på den av guiden förutbestämda rutten.
  Godkänd hjälm ska användas enligt svensk lag. Körning på motorväg, i terräng eller på bana är förbjuden. Vidareuthyrning, bogsering eller transport av farligt gods är inte tillåtet.
• Säkerhet under färd: Det är förbjudet att använda mobiltelefon, fotografera eller
  filma under färd. Om kunden tappar kontakten med gruppen ska fordonet stannas
  säkert och guiden kontaktas.
• Lagansvar: Föraren är personligen ansvarig för samtliga följder vid brott mot lagar och regler under hyresperioden.

5. Överlämnande av fordonet

Innan förarna tillåts ta över fordonet ska samtliga godkända förare visa upp giltig
identitetshandling (ID-kort eller pass), sitt giltiga fysiska B-körkort samt ett giltigt betal- eller kreditkort.

• Fordonets skick: Fordonet överlämnas i trafiksäkert skick. Eventuella befintliga
  skador eller fel ska påtalas av hyrestagaren omedelbart vid genomgången före start.
• Instruktioner: Genomgång av fordonet sker i samband med överlämnandet. Genom att ta emot fordonet bekräftar hyrestagaren att denne fått tillräckliga instruktioner om fordonets funktioner och handhavande.

6. Återlämning

Fordonet samt all lånad utrustning (t.ex. hjälm och väst) ska vid turens avslutning
återlämnas till guiden på utsedd plats i gott, välvårdat och oskadat skick. Hyrestagaren är
skyldig att ersätta eventuella skador eller förluster som uppkommit under turen till följd av vårdslöshet eller regelbrott. Vid allvarliga avtalsbrott eller bristande regelefterlevnad under pågående tur äger Uthyraren eller guiden rätt att omedelbart avbryta turen och återta fordonet på plats.

7. Åtgärder vid skada, olycka eller driftstopp

Vid skada, olycka eller stöld ska hyrestagaren omedelbart:

1. Kontakta polisen (gäller även viltolyckor och singelolyckor).
2. Dokumentera plats, tid, inblandade parter, registreringsnummer och göra en skiss.
3. Inte medge skuldansvar på platsen.
4. Informera Uthyraren omedelbart.

Reparationer får endast utföras efter skriftligt godkännande från Uthyraren.

8. Hyrestagarens ansvar och självrisk

Hyrestagaren är personligen ansvarig för alla skador och förluster på fordonet (inklusive
utrustning) som uppstår under turen till följd av hyrestagarens vållande eller vårdslöshet.

• Skadeersättning (Maxtak): Vid skada är hyrestagaren skyldig att ersätta Uthyrarens
  faktiska reparations- och återställningskostnader, upp till högst 20 000 SEK per skadetillfälle.
• Självriskreducering (Valfritt tillval): Hyrestagaren har möjlighet att vid bokning eller
  före turens start köpa till en självriskreducering mot en tilläggsavgift. Detta sänker det maximala skadeansvaret från 20 000 SEK till högst 5 000 SEK per skadetillfälle.
• Obegränsat ersättningsansvar: Varken maxtaket (20 000 SEK) eller självriskreduceringen (5 000 SEK) gäller vid grov vårdslöshet, uppsåt, körning under påverkan av alkohol/droger/läkemedel eller uppenbart brott mot guidens anvisningar och säkerhetsreglerna. I dessa fall är hyrestagaren skyldig att ersätta den fulla skadekostnaden, samt eventuella bärgningskostnader och utebliven hyresintäkt.
• Trafikförseelser: Hyrestagaren ansvarar personligen för alla trafikförseelser, parkeringsböter och lagöverträdelser under turen.

9. Uthyrarens ansvar och brister

• Trafikförsäkring ingår enligt svensk lag. Skador på personlig egendom ersätts inte.
• Om fordonet drabbas av funktionsfel utan hyrestagarens vållande och felet inte kan avhjälpas inom 90 minuter äger hyrestagaren rätt att häva avtalet och få inbetalt belopp återbetalt. Uthyraren ansvarar inte för följdskador eller indirekta kostnader (t.ex. resekostnader).

1O. Personuppgifter och marknadsföring

• Personuppgifter behandlas i enlighet med gällande dataskyddslagstiftning (GDPR).
• Foto och video: Före turen får kunden skriftligen bekräfta om foto- och videomaterial från turen får användas i Uthyrarens marknadsföring (t.ex. sociala medier och hemsida). Om kunden inte godkänner publicering raderas materialet ur Uthyrarens arkiv inom en (1) månad.
• Återkallande och radering: Kunden kan när som helst kontakta Uthyraren med begäran om att bilder tas bort ur arkivet. Om kunden önskar att publicerade inlägg tas bort, behöver kunden specificera vilket eller vilka inlägg det gäller för att Uthyraren ska kunna radera dem.

11. Lagval och tvist

Svensk lag tillämpas på detta avtal. Tvist med anledning av detta avtal ska avgöras av svensk allmän domstol.

SAFETY RULES – HOT ROD RIDERZ

These terms and conditions apply to the rental of a vehicle ("Mini Hot Rod") from Scharrenberg & Magnusson AB (Reg. No: 559550-8481), hereinafter referred to as the Lessor.

Language Clause: This English translation is provided for convenience. In the event of any conflict, discrepancy, or ambiguity between the Swedish original version and this English translation, the Swedish version shall prevail under Swedish law.

SAFETY RULES

Participation is entirely at your own risk. In the event of a violation of the safety rules, the Lessor or the appointed guide reserves the right to immediately terminate the tour. The contract will thereby be considered fully performed by the Lessor, and no refund will be issued. Any potential vehicle return transport will be at the participant's expense.

• ID and Driver's License: A valid physical Class B driver's license and a valid ID document must be presented prior to departure.
• Sobriety and Drugs: A strict 0.0 BAC limit and an absolute prohibition on drugs and medications affecting driving ability apply.
• Clothing: Sturdy, closed-toe shoes are mandatory (no flip-flops, pumps, or high heels). Weather-appropriate clothing is required, without loose or flapping details (e.g., fluttering scarves).
• Group Driving Conduct:
  • No overtaking within the group. Changing the driving order is only permitted upon direct instruction from the guide.
  • Driving side-by-side is strictly prohibited.
  • Aggressive driving (drifting, wheel spinning, screeching tires) and intentionally lagging behind are prohibited.
  • Leaving the group during an ongoing tour is strictly forbidden.
• Weather and Road Conditions: In wet road conditions, speed must be significantly reduced. Tours will be canceled in the event of persistent heavy rain. Driving on snow, ice, or off-road is strictly prohibited.
• Equipment and Passengers:
  • No additional luggage or bags may be carried in the vehicle (large handbags, backpacks, etc.).
  • No mobile phone use, photography, or filming while driving.
  • No passengers (including children or pets) are permitted.
  • The brake and accelerator pedals must not be operated simultaneously.
• Other Rules:
  • Vehicles are rented exclusively as part of guided tours. Individual vehicle rentals are not offered.
  • Racing or speed-oriented driving is strictly prohibited.
  • Instructions from the guide must be followed at all times.
• Every vehicle is equipped with a warning triangle and a first-aid kit.

GENERAL TERMS & CONDITIONS FOR RENTAL

1. Scope of Agreement

The rental of the vehicle is based on the booking confirmation provided as well as these general terms and safety rules. A completed booking and the issued booking confirmation, together with these terms, constitute the complete, binding rental agreement between the renter and Scharrenberg & Magnusson AB (Hot Rod Riderz). Oral agreements are only valid if confirmed in writing by the Lessor. The Lessor reserves the right to refuse rental service without providing specific reasons.

2. Booking, Payment, and Cancellation

• Booking and Payment: A booking becomes binding upon written confirmation from the Lessor. The rental fee must be paid in connection with the booking. A digital rental agreement, provided as a form by the Lessor, must be completed and signed before the tour begins.
• Cancellations by Customer:
  • Free cancellation and rescheduling can be made up to 24 hours prior to the scheduled tour start time.
  • In the event of a no-show, late arrival (later than 20 minutes before departure), or any delay preventing participation, no refund will be issued.
  • In case of sudden illness on the day of the tour, the paid amount will be refunded in the form of a gift voucher.
  • If the customer voluntarily chooses to interrupt or shorten an ongoing tour, a refund for the unused time will be issued as a gift voucher
• Cancellations by the Lessor:
  • If a tour must be canceled due to severe weather conditions or unforeseen events beyond the Lessor's control (Force Majeure), the customer will be offered rescheduling to a new date, a gift voucher, or a full refund.
  • If the Lessor cancels a tour due to technical breakdowns, the full amount will be refunded to the customer.

3. Vehicle Characteristics and Assumption of Risk

The vehicle is a specialized vehicle with handling characteristics that differ from regular passenger cars. Driving is at your own risk. The Lessor assumes no liability for damage resulting from the unique design of the vehicle.

• Special Features: Low profile (reduced visibility in traffic), no seat belts, ABS, or airbags, automatic transmission with direct steering, and left-foot braking.
• The renter is required to familiarize themselves with the vehicle prior to departure through a test drive instructed by the guide.
• Weather protection is absent.
• Damages caused by weather conditions are not covered by the Lessor.

4. Driver Requirements and Vehicle Usage

Only drivers explicitly named in the rental agreement are authorized to operate the vehicle. All drivers must be at least 18 years old and hold a valid physical Class B driver's license.

• Sobriety and Driving Capability: Driving under the influence of alcohol, drugs, or impairing medication is strictly prohibited. The driver's ability to operate the vehicle safely must remain fully intact. Scharrenberg & Magnusson AB (Hot Rod Riderz) and the designated guide reserve the right to immediately terminate participation upon suspicion of unfitness to drive.
• Driving Rules: The vehicle may only be operated along the pre-determined route
  designated by the guide. Wearing an approved helmet is required by Swedish law.
  Driving off-road, or on race tracks is strictly forbidden. Subletting, towing, or transporting hazardous materials is prohibited.
• Safety During Driving: Using a mobile phone, photographing, or filming while driving is strictly prohibited. If a participant loses contact with the group, they must stop safely and contact the guide.
• Legal Liability: The driver is personally liable for all legal consequences resulting from violations of laws or traffic regulations during the rental period.

5. Handover of the Vehicle

Prior to vehicle handover, all authorized drivers must present a valid identity document (ID card or passport), their valid physical Class B driver's license, and a valid debit or credit card.

• Vehicle Condition: The vehicle is handed over in a roadworthy condition. Any pre-existing damage or defects must be reported by the renter immediately during the inspection prior to departure.
• Instructions: A vehicle briefing is conducted upon handover. By taking possession of the vehicle, the renter confirms that they have received adequate instructions regarding the vehicle's functions and operation.

6. Return of the Vehicle

The vehicle and all provided equipment (e.g., helmet and vest) must be returned to the guide at the designated location immediately upon conclusion of the tour in good, well-maintained, and undamaged condition. The renter is obligated to compensate for any damage or loss occurring during the tour resulting from negligence or rule violations. In the event of a severe breach of contract or failure to follow safety rules during the tour, the Lessor or guide reserves the right to terminate the tour immediately and repossess the vehicle on the spot.

7. Duties in Case of Accidents, Damage, or Breakdowns

In case of accident, damage, or theft, the renter must immediately:

1. Contact the police (including single-vehicle and wildlife accidents).
2. Record the location, time, involved parties, license plates, and draw a sketch.
3. Refrain from admitting liability at the scene.
4. Notify the Lessor without delay.
   

Repairs may only be carried out with prior written consent from the Lessor.

8. Renter's Liability and Deductible

The renter is personally liable for any damage to or loss of the vehicle (including equipment) occurring during the tour caused by the renter's fault or negligence.

• Damage Compensation (Cap): In the event of damage, the renter is required to compensate the Lessor for the actual repair and restoration costs, capped at a maximum of 20,000 SEK per incident.
• Deductible Reduction (Optional Add-on): The renter has the option to purchase a deductible reduction for an additional fee upon booking or prior to the start of the tour. This reduces the maximum damage liability from 20,000 SEK to a maximum of 5,000 SEK per incident.
• Unlimited Financial Liability: Neither the liability cap (20,000 SEK) nor the reduced deductible (5,000 SEK) applies in cases of gross negligence, intent, driving under the influence of alcohol/drugs/medication, or willful violation of safety rules and guide instructions. In such cases, the renter is obligated to pay the full cost of repairs, as well as any towing fees and loss of rental income.
• Traffic Violations: The renter is personally liable for all traffic violations, parking fines, and legal infractions incurred during the tour.

9. Lessor’s Liability and Vehicle Defects

• Statutory third-party liability insurance is included in accordance with Swedish law. Damage to personal belongings is not covered.
• If the vehicle suffers a mechanical malfunction through no fault of the renter and cannot be repaired within 90 minutes, the renter may cancel the contract and receive a full refund of paid fees. The Lessor is not liable for indirect or consequential damages (e.g., travel expenses).

1O. Personal data and marketing

• Personal data is processed in accordance with applicable data protection legislation (GDPR).
• Photo and Video: Prior to the tour, the customer may confirm in writing whether photo and video material from the tour may be used for the Lessor's marketing purposes (e.g., social media and website). If consent is not given, the material will be deleted from the Lessor's archives within one (1) month.
• Revocation and Removal: The customer may contact the Lessor at any time to request the removal of photos from the archive. If the customer wishes to have published posts removed, they must specify the particular post(s) concerned so the Lessor can delete them.

11. Governing Law and Jurisdiction

This agreement shall be governed by Swedish law. Any disputes arising from this contract shall be submitted to the exclusive jurisdiction of Swedish general courts.
